Dear clients and partners, we take your privacy very seriously.


Please read this privacy policy carefully as it contains important information on who we are and how and why we collect, store, use and share personal data. It also explains your rights in relation to your personal data and how to contact us or supervisory authorities if you have a complaint.

WHO ARE WE AND WHAT DO WE DO?

KONEXIO is a non-profit organization based in Paris (France) that partners with KONEXIO AFRICA, a Non-Governmental Organization (NGO), with headquarters in Nairobi (Kenya). KONEXIO offers digital and digitally enabled services, specializing in the delivery of customized remote solutions, and actively engages with committed private and public partners, along with volunteers, trainers, collaborators, and freelancers/contractors.

When we provide you with digital services we collect, use and are responsible for certain personal data about you, your team, and/or your client. When we do so we are subject to the EU General Data Protection Regulation (EU GDPR) in relation to services we offer in the European Economic Area (EEA).

PERSONAL DATA WE COLLECT

The personal data we collect depends on the particular services we provide to you. We will generally collect and use the following categories of personal data:

  • Identification Data: name, date of birth, nationality, identification documents (e.g., passport, national ID, or driving license)

  • Contact Data: address, Email address, telephone numbers, location data

  • Professional Data: job title or role, employment history, education or qualifications

  • Financial Data (if applicable): bank account details, payment records, Tax identification numbers

  • Sensitive Personal Data (only if explicitly required and lawfully justified): health information, racial or ethnic origin, political opinions, religious or philosophical beliefs (if relevant to the NGO's mission)

  • Usage Data: information from accounts you link to us (eg Linkdlin), IP addresses and log files (if using digital platforms for collaboration)

  • Communication Data: emails, text messages, or other correspondence, social media interactions (if relevant to project goals).

We collect and use this personal data for the purposes described in the section ‘How and why we use your personal data’ below.

HOW PERSONAL DATA IS COLLECTED

We collect most of the above information from you. However, we may also collect information:

  • from publicly accessible sources 

  • directly from a third party

  • from a third party with your consent 

  • via our information technology (IT) systems.

HOW AND WHY WE USE PERSONAL DATA

Under data protection law, we can only use your personal data if we have a proper reason:

  • you have given consent—where we need your consent, we will ask for it separately of this privacy policy and you can withdraw consent at any time;

  • to comply with our legal and regulatory obligations;

  • to fulfil our contract with you or take steps at your request before entering into a contract; or

  • for our legitimate interests or those of a third party.

We collect and process your personal data to fulfil and perform our contractual obligations with you.   

Where we process special category personal data (see above ‘Key terms’), we will also ensure we are permitted to do so under data protection laws:

  • we have your explicit consent;

  • the processing is necessary to protect your (or someone else’s) vital interests where you are physically or legally incapable of giving consent; 

  • the processing is necessary to establish, exercise or defend legal claims; or

  • the processing is necessary for reasons of substantial public interest.

WHO WE SHARE PERSONAL DATA WITH

We routinely share personal data with:

  • third parties we use to help deliver our services to you, as IT service providers including cloud service providers such as data storage platforms, shared service centres and financial institutions in connection with invoicing and payments

  • freelancers/contractors who delivered the services required by you

  • Konexio and Konexio Africa Team 

We ensure all outsourcing providers operate under service agreements that are consistent with our legal obligations.

WHERE YOUR PERSONAL DATA IS HELD

Personal data may be held at our premises and those of Konexio or Konexio Africa, third party agencies, service providers, representatives and agents as described above (see ‘Who we share your personal data with’).

Some of these third parties may be based outside the European Union. For more information, including on how we safeguard your personal data when this occurs, see below: “Transferring your personal data abroad’.

HOW LONG YOUR PERSONAL DATA WILL BE KEPT

We will not keep your personal data for longer than we need it for the purpose for which it was collected or as required by law.

If we are no longer providing services to you, we will usually delete your account data after one year.

Following the end of the relevant retention period, we will delete your personal data.

TRANSFERRING YOUR PERSONAL DATA ABROAD

If we transfer personal data outside the European Union (EU) or European Economic Area (EEA), we ensure that appropriate safeguards are in place, such as:

  • Standard Contractual Clauses approved by the European Commission.

  • Transfers to countries recognized by the European Commission as offering adequate protection.

YOUR RIGHTS

You have the following rights, which you can exercise free of charge:

If you have provided us with a consent to use your personal data you have a right to withdraw that consent at any time

Withdrawing consent will not affect the lawfulness of our use of your personal data in reliance on that consent before it was withdrawn

The right not to be subject to a decision based solely on automated processing (including profiling) that produces legal effects concerning you or similarly significantly affects you

Not to be subject to automated individual decision making

The right to object:

—at any time to your personal data being processed for direct marketing (including profiling);

—in certain other situations to our continued processing of your personal data, eg processing carried out for our legitimate interests unless we demonstrate compelling legitimate grounds for the processing which override your interests or for establishing, exercising or defending legal claims

The right to receive the personal data you provided to us, in a structured, commonly used and machine-readable format and/or transmit that data to a third party—in certain situations

  • provide enough information to identify yourself and any additional identity information we may reasonably request from you;

  • let us know what right you want to exercise and the information to which your request relates.

KEEPING YOUR PERSONAL DATA SECURE

We make every effort to protect your personal data, by implementing appropriate technical and organisational measures to keep your personal data confidential and secure from unauthorised access, use and disclosure. We limit access to your personal data to those who have a genuine business need to access it. Those processing your personal data will do so only in an authorised manner and are subject to a duty of confidentiality. 

We require our business partners, suppliers and other third parties to implement appropriate security measures to protect personal data from unauthorised access, use and disclosure.

We also have procedures to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are required to do so.

You may also have the right to lodge a complaint with the relevant supervisory authority in your jurisdiction.

CHANGES TO THIS PRIVACY POLICY

This privacy policy was published on 1st of January 2025.

We may change this privacy policy from time to time. When we do, we will publish the updated version on our website and ask for your consent to the changes if legally required.
